These Terms of Service govern the use of the vacation rental service provided by Landhaus.com GmbH ("Landhaus.com", "we", "Platform"). By using our services, you accept these terms.
1. Scope of Services
Landhaus.com is an online platform that connects hosts and guests. We facilitate vacation rental bookings and related services. Landhaus.com is not the landlord of the accommodations; the rental agreement is made directly between the guest and host.
2. Service Fees
2.1 Guest Service Fee
A service fee of 8% of the booking amount (excluding cleaning fee) is charged for each booking. This fee covers: booking processing, payment protection, 24/7 support during your trip, dispute mediation, and booking confirmation with all relevant information.
2.2 Host Service Fee
Hosts pay a service fee of 3% per successful booking. This fee includes: listing creation and management, payment processing and payout, calendar synchronization, booking management dashboard, and marketing reach on the platform.
2.3 Payment Processing
Payment is collected upon booking confirmation. Payout to the host occurs 24 hours after guest check-in, minus the host service fee. For hosts registered with Stripe Connect, payouts are made directly to the linked account.
3. Booking & Contract
By completing a booking, a rental agreement is established between guest and host. Landhaus.com acts solely as an intermediary. The guest agrees to the house rules, cancellation policy, and rental price. The host commits to providing the accommodation as described.
4. Cancellation Policies
Flexible
Free cancellation up to 24 hours before check-in. For later cancellations, the first night is charged.
Moderate
Free cancellation up to 5 days before check-in. Cancellations 1-4 days before check-in incur a 50% charge of the total amount. Cancellations less than 24 hours before or no-shows are charged in full.
Strict
Free cancellation within 48 hours of booking if check-in is at least 14 days away. After that: 50% refund up to 7 days before check-in. No refund for later cancellations.
Super Strict
50% refund up to 30 days before check-in, minus service fees. No refund for later cancellations.
The guest service fee is non-refundable upon cancellation unless due to host fault or extraordinary circumstances.
5. Liability
- Landhaus.com is not liable for the accuracy of information provided by hosts. Hosts are responsible for accurately representing their accommodation.
- For damages occurring during a stay, the contracting parties (guest/host) are directly liable to each other.
- Landhaus.com assumes no liability for force majeure, natural disasters, pandemics, or governmental orders.
- The platform mediates disputes but is not obligated to enforce any particular resolution.
- Our liability is limited to intent and gross negligence. Liability for indirect damages and lost profits is excluded.
6. User Obligations
6.1 Guest Obligations
- Provide truthful information during registration and booking
- Comply with the host's house rules
- Handle the accommodation and inventory with care
- Timely payment and adherence to check-in/check-out times
- Promptly report defects or damages
6.2 Host Obligations
- Provide accurate and up-to-date accommodation descriptions
- Deliver the accommodation as booked
- Comply with all local laws and regulations (rental permits, taxes, etc.)
- Reasonable response time to inquiries and issues
- Provide safe and clean accommodations
7. Privacy
The processing of personal data is governed by our Privacy Policy. For more information, please see our Privacy Policy
8. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For merchants, the place of jurisdiction is Munich. Should any provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that most closely reflects its economic purpose.
Changes to these Terms will be communicated to users via email and on the platform. Continued use after the effective date constitutes acceptance.
